Terms of service

This is a plain-language draft, not legal advice. Have an attorney review it for your jurisdiction before you rely on it.

What this is

Lumela is software for collecting consent forms, waivers and client intake in appearance businesses. You use it to gather and store records about your own clients. We provide the software; the records are yours and the relationship with your clients is yours.

Your account

You are responsible for what happens under your login and for anyone you invite to your team. Tell us promptly if you think somebody else has access to your account. One person, one login - sharing a login across staff defeats the audit trail that makes your records worth keeping.

The template wording is a starting point

The consent, waiver and intake wording we ship is drafted to be professional and complete, but it is not legal advice and we are not your lawyers. Requirements vary by state, country and treatment. Have an attorney review the wording you actually use. You remain responsible for the legal adequacy of your forms and for meeting any retention rules that apply to your profession.

What you must not do

Do not use the product to collect information you have no lawful basis to collect, to impersonate anyone, or to break the law. Do not use it for medical care requiring a licensed practitioner or prescribing authority - it is not built for that and makes no clinical claims.

Availability

We work to keep the service running and will give reasonable notice of planned downtime, but we do not promise uninterrupted availability. Your archive remains exportable, which is the point that matters: you are never locked out of your own records by our outage.

Payment and cancellation

Plans are billed monthly or annually in advance and renew automatically until cancelled. Cancel any time and you keep access until the end of the period you have paid for. After cancellation your submissions and their PDFs remain available for export for 90 days, then may be deleted.

Ending the agreement

You can stop using the service whenever you like. We may suspend an account that is being used unlawfully or that puts the service or other customers at risk, and we will tell you why unless we are legally prevented from doing so.

Liability

To the extent the law allows, our total liability to you is limited to the amount you paid us in the twelve months before the claim. We are not liable for the content of your forms, for decisions you make about treating a client, or for losses arising from you not reviewing a flag we raised.

Changes

We may update these terms. If a change materially affects you we will tell you by email before it takes effect. Questions go to legal@lumela.co.
